1. Acceptance of Terms

By accessing or using Cognitino, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. For users under 18, a parent or guardian must accept these terms on their behalf.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. Each account is for a single user — students, parents, and administrators each have distinct roles with specific permissions. You agree not to share your account or attempt to access another user's data.

3. Acceptable Use

You agree to use Cognitino only for its intended educational purposes. You must not attempt to manipulate mastery scores, bypass assessment safeguards, or misuse the AI assistance features. Content submitted through the platform must be appropriate for educational settings.

4. AI-Powered Features & Automated Decision-Making (ADM)

Cognitino utilizes deterministic algorithmic systems to calculate capability mastery, evaluate assessment submissions, and enforce curriculum prerequisite gating. Under the Australian Privacy Act 1988 (Cth) (incorporating the 2024 amendments, enforceable December 10, 2026), users have the right to transparent information and human review regarding automated decisions.

Generative AI (LLMs) operates exclusively as a non-authoritative educational assistant (Layer 5) providing hints, concept explanations, and reading level adaptation. AI is strictly prohibited from scoring answers, awarding mastery, or making binding progression decisions.

Learners and linked parents have the right to request an explanation or appeal any automated decision through our ADM Transparency Portal or by contacting adm-transparency@cognitino.com.

4.1 Parental Consent (COPPA) & School Authorization (FERPA)

For student users under 13, account activation is strictly conditioned upon verifiable parental consent pursuant to theChildren's Online Privacy Protection Act (COPPA, 16 CFR Part 312). Educational institutions enrolling students represent and warrant that they have the legal authority to authorize access under the Family Educational Rights and Privacy Act (FERPA, 34 CFR § 99.31(a)(1)(i)) "School Official" exception, designating Cognitino as an authorized school official acting under the institution's direct administrative control.

5. Intellectual Property

All content, design, and code on Cognitino are the intellectual property of Cognitino or its licensors. Learning materials, assessments, and skill definitions are proprietary. You may not reproduce, distribute, or create derivative works from platform content without permission.

6. Limitation of Liability

Cognitino is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability is limited to the amount you paid for the service in the preceding 12 months.
